A long-running legal battle involving a South Fulton horse owner is now before a federal appeals court. Brandon Fulton, known as the “Urban Horseman,” is asking a federal appeals court to order compensation after county officials seized and later sold his horses following animal cruelty allegations nearly a decade ago. Those criminal charges were ultimately dismissed. Fulton’s attorneys argue the county violated the Fifth Amendment’s Takings Clause by keeping and selling his horses without providing compensation after the case against him fell apart. They say the government cannot take private property without paying just compensation. Fulton says he was never indicted and was shocked to learn his horses were being sold only months after his arrest. County attorneys have not conceded that a legal “taking” occurred. The outcome could have implications far beyond Fulton’s case, potentially setting precedent on how governments handle property seized during criminal investigations.
